These Terms and Conditions of use apply to your accessing, browsing, posting, uploading, emailing or otherwise transmitting, editing, modifying or deleting of promo texts, presentations, descriptions, journals, recommendations, reviews, opinions, news articles, directories, guides, text, photographs, illustrations, graphics, logos, audio clips, images, videos, information, data, software, messages, ideas, comments, questions, or any other materials on your profile pages or registered users areas (the “User Generated Content”) at danube.travel (the “Website”).
By using your profile pages or registered users areas on the Website you signify that you unconditionally agree and accept to be legally bound by all of these Terms and Conditions as well as by all of the DANUBE.TRAVEL General Website Terms and Conditions of Use (“General Terms and Conditions) which are incorporated into these Terms and Conditions. To the extent any General Terms and Conditions conflict with these Terms and Conditions, these Terms and Conditions will prevail. If you do not agree with any part of these Terms and Conditions, you are obliged to immediately discontinue use of your profile pages and registered users areas on the Website.
By using your profile pages and/or registered users areas on the Website you agree that you are an entity that operate as a provider of tourism and/or travel related services (the “Entity”) or a registered user and are able to create binding legal obligations for any liability you may incur as a result of the use of your User Generated Content on the Website.
By your accessing, browsing, posting, uploading, emailing or otherwise transmitting, editing, modifying or deleting your User Generated Content on your profile pages you agree that you are owner, officer, director, employee, agent, other representative of the Entity listed on your profile pages or howsoever authorised by the Entity to do so.
By your accessing, browsing, posting, uploading, emailing or otherwise transmitting, editing, modifying or deleting your User Generated Content on registered users areas you agree that you are the person listed in your User Generated Content and depicted in any images or recordings submitted as part of your User Generated Content. If you upload any images or recordings of any third party, you have obtained the prior written consent of that party to submit such User Generated content to the Website.
You may access, browse, post, upload, email or otherwise transmit, edit, modify or delete your Use Generated Content to the Website as long as you comply with the Website’s architecture, technical and content standards, these Terms And Conditions and all General Terms and Conditions including, but not limited to, sections Acceptable use of website, Grant of rights and User registration.
Names of your profile pages and headings in other User Generated content must accurately reflect corresponding content and must not be misleading or confusing.
You are entitled to collect information and/or data directly from visitors of your profile pages or your User Generated Content of registered users areas, only in case you provide the visitors with the notice that these information and/or data are not collected by DCC and obtain visitors’ consent for your use of the information and/or data that you collect.
In addition to registration procedure you need to follow as referred to in section User Registration of the General Terms and Conditions, before you are able to post, upload, edit or modify the User Generated Content you need to provide DCC with all information and/or data that DCC may require from you, complete the required forms and questionnaires and accept these Terms and Conditions. Once you have done this, DCC will send you a confirmation email with information on your access rights for administration of corresponding database entities on the Website. Criteria for allocation of access rights remain in DCC’s sole discretion.
Any and all of the User Generated Content will be subject to DCC approval prior to being published on the Website. After you post, upload, edit or modify the User Generated Content on your profile pages and registered users areas, such User Generated Content will remain visible only to you in off-line mode for reviewing purposes. Once DCC finds such User Generated Content complies with the Website’s architecture, technical and content standards, these Terms and Conditions, DCC will make it visible in on-line mode.
In case you suspect that any other users activities in respect of your User Generated Content violates law, infringes your intellectual, other property or any other rights, or breach these Terms and Conditions, you are entitled to contact DCC as soon as possible at support@danube.travel. DCC will try to resolve your issue as fast as possible and in the most cost-efficient manner, directly with such users, although DCC cannot provide any guarantees. In case DCC finds your complaints legitimate, DCC retains the right to temporarily or permanently suspend such users’ use of the Website as well as to delete in whole or in part the content such users have generated without explanations and/or reason.
You are not bound by the provisions of Intellectual property section of the General Terms and conditions that prohibits copying, duplication, distribution, commercial exploitation, modification, adding and/or deletion, including the integration of any content on external websites, for example through interlinks, deeplinks, or frames, in respect of your User Generated Content.
Advertising material can be published only by Entities on their profile pages and not by registered users on registered users areas.
You are responsible for ensuring that all advertising material on your profile pages comply with all applicable law and these Terms and Conditions and does not contain false, misleading, fraudulent, or deceptive claims or content.
You are not entitled to publish advertising material of third parties on your profile pages.
